Understanding the 48-Hour Opt-Out Agreement
If you’re registering with a recruitment agency like Step Teachers, you might be asked to sign a 48-hour opt-out agreement. It might sound formal, but don’t worry — here’s what it actually means, why we ask for it, and what your rights are.
What Is the 48-Hour Opt-Out?
Under UK law, most workers can’t be required to work more than an average of 48 hours per week, as part of the Working Time Regulations 1998.
The opt-out agreement allows you to choose to work more than this limit if needed. Signing it gives you a bit more flexibility with your working week.
Does This Apply to School Work?
In most cases, no — not on its own.
Schools operate various hours between 8:00am and 4:00pm, which typically adds up to well under 48 hours per week, even if you're working full-time across five days.
However, if you have another job alongside your work with Step Teachers — such as evening, weekend, or holiday work — your combined hours across all jobs might go over the 48-hour limit. That’s when the opt-out might apply.
Why Do Agencies Include It?
We include the opt-out in your registration documents so you’re covered for any situation where your total working hours might go over 48 in a week — especially if:
- You’re taking on multiple roles
- You want more flexibility
- You’re available for short-notice or longer-term placements
It doesn’t mean you have to work over 48 hours — just that you’re giving yourself the option.
